Donald Trump has decided against testifying for a second time at his New York civil fraud trial, claiming that his first testimony was “VERY SUCCESSFULLY & CONCLUSIVELY”. This trial, brought forward by New York Attorney General Letitia James’ lawsuit, has the potential to greatly harm Trump’s real estate empire and his reputation as a successful businessman.
Trump announced his decision in a statement on his Truth Social platform, writing: “I WILL NOT BE TESTIFYING ON MONDAY.” He added that he had already testified to everything and had nothing more to say.
Trump’s first testimony, which took place on November 6, was marked by defiance and combative behavior. Along with defending his wealth and denying wrongdoing, he often sparred with the judge and slammed James as “a political hack”. During the 3-and-a-half-hour long testimony, Trump’s verbose answers prompted the judge, Arthur Engoron, to admonish him and remind him that “this is not a political rally.”
Had he returned to the stand on Monday, Trump would have been questioned by his defense lawyers, with state lawyers allowed to cross-examine him. James’ lawsuit, which seeks penalties of more than $300 million and a ban on Trump doing business in New York, alleges that Trump duped banks, insurers and others by inflating his wealth on financial statements.
Engoron has already ruled that Trump and other defendants engaged in fraud, and has ordered a receiver to take control of some of Trump’s properties. However, this ruling has been paused by an appeals court. The judge is now considering six other claims, including allegations of conspiracy and insurance fraud.
In recent days, Trump has been insistent on testifying again, despite the gag order that is in place. His lawyer, Alina Habba, advised him against it, but Trump was determined to take the stand to defend “the old America”.
